1. The Contract 

These Booking Conditions apply to your booking with Duke Travel Limited trading as Isle of Man Experiences, Isle of Man Company Number 131439C, with its registered office at Champion House, Tromode, Isle of Man IM99 1DD (“we”, “us”, “our”).

Binding Agreement: By making a booking, you agree on behalf of all persons detailed on the booking that you have read these terms and conditions and agree to be bound by them.

Jurisdiction: Your booking agreement is made under the laws of the Isle of Man. You submit to the exclusive jurisdiction of the Manx courts.

2. Data Protection

We take your privacy seriously. We will use personal information in accordance with the Data Protection Act 2018 (Isle of Man) and our Privacy Policy. It is your responsibility to ensure all information provided (names, dates, contact details) is accurate and truthful.

3. Passenger Conduct & Safety

Seating: Every passenger in a vehicle must have their own seat. Seats cannot be reserved.
Seatbelts: It is compulsory for all passengers to wear seatbelts whilst the vehicle is in motion.
Smoking: Smoking (including e-cigarettes) is strictly prohibited on all company vehicles.
Alcohol: Alcohol is strictly prohibited on all company vehicles. Anyone failing to comply will be required to vacate the vehicle immediately.
Behaviour: The driver is responsible for the safety of the vehicle. Any passenger whose conduct is in breach of statutory regulations, or who distracts the driver, may be removed from the vehicle or denied boarding.

4. Accessibility & Disabilities

Vehicle Access: Please be aware that our vehicles are typically minibuses, which require passengers to climb steps to board. We regret that our standard fleet is not currently equipped with wheelchair lifts or ramps.
Mobility: We are happy to carry folding wheelchairs and walking frames, provided they can be stored in the luggage hold. Space is allocated on a first-come, first-served basis. You must inform us at the time of booking if you intend to bring mobility aids. Passengers must be able to board the vehicle independently or with the assistance of their own carer.

5. Liability & Delays

Transport: Return times are approximate. We do not guarantee arrival times and are not liable for any loss of convenience or missed connections (e.g., ferries, flights, or trains) arising from delays, breakdowns, or traffic.

Route Variations: In the event of severe weather (e.g., Mountain Road closures), roadworks, or operational reasons, we reserve the right to alter tour routes without notice.

Lost Property: We are not responsible for items left on our vehicles. If lost property is found, we can return it to the customer at the customer’s expense. Unclaimed items are disposed of after 3 months.

6. Animals 

No animals, other than registered assistance dogs, are permitted on scheduled tour vehicles.


SCHEDULED TOUR TERMS

(For individual seats on day tours/experiences)

1. Booking & Payment 

All scheduled tours must be paid in full prior to departure. We accept major credit and debit cards.

2. Cancellation & Refunds

24-Hour Policy: You may cancel your scheduled tour up to 24 hours prior to the departure time to receive a full refund.
Late Cancellation: Cancellations made within 24 hours of the tour departure are non-refundable.
Third-Party Bookings: If you booked through an Online Travel Agent (OTA), you must contact the OTA directly to cancel, as its terms will apply.

3. Operational

Missed Departure: Our tours depart at the scheduled times stated in your booking confirmation. We cannot wait for late arrivals. A missed departure or “no-show” will not be refunded.

Luggage: Passengers are restricted to one small day bag per person due to vehicle storage limits. We may not be able to accommodate large suitcases on scheduled day tours.

Children: Children under 5 are generally not permitted on scheduled shared tours; children 5–16 must be accompanied by an adult.
Courtesy Seating: Although we cannot reserve seats, if you require a specific seat due to a medical condition or disability, please contact us. We will endeavour to allocate courtesy seating, though this cannot be guaranteed.


PRIVATE HIRE & BESPOKE TERMS

(For private groups and transfers)

1. Booking & Payment

Deposit: To confirm a private hire, a non-refundable deposit is required at the time of booking.
For hires under £500: A deposit of £50.00 per vehicle is required.
For hires over £500: A deposit of 20% of the total booking value is required.
Balance: The remaining balance is due 14 days prior to the hire date.

2. Cancellation Policy (Private Hire)

If you cancel your private booking, the following charges apply based on the notice given:
14 days or more: Loss of deposit.
7 – 13 days: 50% of the total price.
3 – 6 days: 75% of the total price.
48 hours or less: 100% of the total price.

3. Surcharges & Damage

Overtime: We reserve the right to charge an additional fee (e.g., £85 per hour) if the vehicle is detained longer than contracted.
Damage: The hirer is responsible for any damage caused to the vehicle by passengers.
Child Seats: You must advise us of any children travelling so appropriate seating can be arranged. We reserve the right to refuse transport for children under 3 if a seat is not booked/available.


AGENCY BOOKING TERMS

(Use this when selling third-party workshops, tickets, or tours)

1. Agency Status

This section applies to bookings we make for you when acting as a booking agent.
Your Contract: When we book a workshop, accommodation, or third-party tour, your contract is with the supplier (e.g., the hotel or attraction), not with us.
Supplier Terms: The supplier’s Terms & Conditions will apply to your booking. We advise you to read these carefully.

2. Liability

Role: As an agent, we accept no responsibility for the acts or omissions of the supplier or for the actual provision of the arrangements.
Limit: Our maximum liability to you in respect of agency bookings is limited to twice the cost of your booking.

3. Changes & Cancellations

Supplier Rules: If you cancel or amend, the supplier may charge cancellation fees (up to 100%).
Admin Fee: We may charge an administration fee of £25.00 per amendment in addition to any supplier fees.


PACKAGE BOOKING TERMS

(Use ONLY when bundling Accommodation + Transport/Tours as a Principal)

1. The Contract

These terms apply to Package Bookings where we act as the Organiser under the Package Travel and Linked Travel Arrangements Regulations 2018.

2. Financial Protection (ABTOT)

The Association of Bonded Travel Organisers Trust Limited (ABTOT) provides financial protection under The Package Travel and Linked Travel Arrangements Regulations 2018 for Duke Travel Ltd, Membership Number 5572, and in the event of their insolvency, protection is provided for:
Non-flight packages ABTOT cover provides for a refund in the event you have not yet travelled or repatriation if transportation was included in your package. Please note that bookings made outside the UK are only protected by ABTOT when purchased directly with Duke Travel Ltd.

3. Booking & Payment

Deposit: A non-refundable deposit of 25% of the total booking value is required at the time of booking.
Balance: The final balance is due 10 weeks (70 days) prior to the arrival date.
Late Booking: Bookings made within 10 weeks of arrival require full payment immediately.

4. Special Events (TT & Manx Grand Prix)

Bookings made for travel during the Isle of Man TT Festival or Manx Grand Prix are subject to strict conditions:
Non-Refundable: These bookings are 100% non-refundable and non-transferable immediately upon booking.

5. Pricing & Surcharges

We reserve the right to alter the prices of unsold holidays. We will not change the price of your holiday within 30 days of departure. We will absorb the first 2% of any cost increase (e.g., fuel), but you will be charged for increases above that.

6. Cancellation by You

If you cancel your Package (outside of TT/MGP dates), the following charges apply:
More than 70 days: Loss of deposit (25%).
29 – 69 days: 50% of the total package price.
28 days or less: 100% of the total package price.

7. If WE Change or Cancel Your Holiday

Minor Changes: We reserve the right to make minor changes (e.g., change of accommodation to a similar standard). We will notify you, but no compensation is payable.
Major Changes: If we make a major change (e.g., changing dates or lower standard accommodation), you may:
Accept the new arrangements.
Accept an alternative holiday (we refund the difference if cheaper).
Cancel and receive a full refund.
Compensation: If we cancel or make a major change (unless due to Force Majeure), we will pay compensation based on the notice given (Scale: Nil for >70 days up to £40 for <14 days).

8. Prompt Assistance

If you are in difficulty whilst on holiday (even if caused by Force Majeure), we will provide appropriate assistance, such as providing information on health services and helping you find alternative communications or accommodation.

9. Liability

We accept responsibility for the arrangements we agree to provide. However, we are not liable for failure to perform due to force majeure, third parties unconnected with the services, or your own acts/omissions. Our liability (except for death/injury) is limited to twice the price paid.

10. Accommodation Standards
Ratings: Star ratings are for guidance only, and standards vary between countries.
Behaviour: We reserve the right to terminate your stay without refund if your behaviour is disruptive or causes damage.

11. Force Majeure

We will not pay compensation if we have to cancel or change your travel arrangements because of unusual or unforeseeable circumstances beyond our control. These include war, civil strife, natural disasters, and adverse weather conditions (including ferry/flight cancellations due to fog or rough seas).


EVENT & HOSPITALITY TICKET TERMS

1. The Contract

These terms apply to the booking of Event Tickets, Grandstand Seats, and VIP Hospitality packages (“Tickets”) with Duke Travel Limited trading as Isle of Man Experiences.

Payment: Full payment is required immediately at the time of booking to secure these Tickets.
Binding: By making a booking, you confirm you accept these special conditions, which override standard cancellation terms.

2. Cancellation & Transfers Due to the special nature of the Isle of Man TT and Classic TT events:

Non-Refundable: All Tickets and Hospitality packages are 100% non-refundable from the moment of booking.
Non-Transferable: Tickets cannot be exchanged, transferred to another person, or resold for commercial gain.
No Exceptions: We are unable to offer refunds for unwanted tickets, regardless of personal circumstances (e.g., illness or travel delays). We strongly recommend you have adequate travel insurance to cover such risks.

3. Age Restrictions (VIP Hospitality)

Strictly 18+: Admission to VIP Hospitality suites/tents is strictly limited to persons aged 18 years and over.
ID Checks: Proof of age (Passport or Driving Licence) may be requested at the entrance.
Refusal of Entry: If a guest is found to be underage or unable to prove their age, they will be denied entry. In this instance, no refund will be given.

4. Event Schedule & Racing

Weather Dependency: Motorcycle racing on the Isle of Man is subject to weather conditions and road safety. Race schedules are provisional and subject to change or cancellation by the race organisers (ACU Events Ltd/Isle of Man Government).
Hospitality Availability: Hospitality facilities will generally remain open, and services (catering/drinks) will be provided on the booked date, regardless of whether racing takes place. No refunds will be due on Hospitality packages if racing is delayed or cancelled due to weather or force majeure.
Grandstand Tickets: Refunds for Grandstand tickets due to race cancellation are governed strictly by the official refund policy of the race organiser (e.g., Isle of Man Government). We will assist you in this process, but we are not liable if the organiser’s policy does not permit a refund.

5. Ticket Delivery

Format: Tickets may be issued as E-Tickets (QR codes) or physical printed tickets/wristbands, depending on the specific event.
Physical Tickets: If physical tickets are lost, stolen, or damaged after they have been received by you, they cannot be replaced or reissued.
Non-Receipt: You must notify us at least 72 hours prior to the event if you have not received your tickets. We are not responsible for tickets lost in the post unless caused by our negligence.

6. Conduct & Alcohol

Venue Rules: Admission is subject to the regulations of the venue owner. You may be searched upon entry.
Behaviour: We (and the venue management) reserve the right to refuse admission or eject any person whose behaviour is disruptive, dangerous, or under the influence of excessive alcohol. No refund will be paid in these circumstances.
Alcohol: Alcohol must be consumed responsibly. Hospitality venues operate a strict policy regarding the service of alcohol and may stop serving any individual at their discretion.

7. Liability

Agency Status: Where we sell tickets for an event organised by a third party (e.g., IOM Govt), we act as an agent. Our liability is limited to the price paid for the ticket. We are not liable for any consequential loss (e.g., accommodation or travel costs) if the event is cancelled.
